Terms of Service.

1. Our services

TestFeed provides AI panel research services calibrated against human benchmarks, delivered as a managed service to enterprise clients and through a self-serve app for Shopify merchants. Specific features, pricing, and deliverables are set out separately in your order form, statement of work, or app listing, not in these Terms.

2. Using our website and services

You agree to:

• Provide accurate information when creating an account or requesting a test
• Use the service only for lawful purposes
• Not attempt to reverse-engineer, scrape, or interfere with the service
• Not use the service to generate content that is unlawful, defamatory, or infringes another party’s rights

We can suspend or terminate access if these Terms are breached.

3. Accounts

You’re responsible for keeping your account credentials secure and for activity that happens under your account. Tell us promptly if you suspect unauthorized access.

4. Intellectual property

TestFeed owns all rights to the website, our methodology, our software, and our branding. Nothing in these Terms transfers that ownership to you.

Test results, reports, and study outputs generated for you are yours to use for your own business purposes. We may use aggregated, de-identified data from your studies for benchmarking, research, and product improvement.

5. Fees and payment

Fees are set out in your order form or subscription plan. Invoices are due within 14 days of issue. Overdue amounts accrue interest at a reasonable commercial rate. We’ll give notice before any pricing change takes effect for your next billing cycle.

6. Confidentiality

Each party agrees to keep the other’s confidential business information private and use it only to perform under these Terms. If a separate confidentiality agreement is in place between us, that agreement governs instead of this section.

7. Disclaimers

The service is provided “as is.” We don’t guarantee that AI panel outputs will predict real-world outcomes with certainty. Test results are a research input to support your decisions, not a substitute for your own judgment.

8. Limitation of liability

The service is provided “as is” and “as available.” To the maximum extent permitted by law, TestFeed is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

9. Termination

Either party can terminate as set out in your order form or app subscription terms. On termination, your right to use the service ends. Data handling on termination is covered in our Privacy Policy, not here.

10. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Before starting court proceedings, both parties agree to try to resolve any dispute through informal negotiation, then mediation, in good faith.

11. Changes to these Terms

We may update these Terms from time to time. We’ll give at least 30 days’ notice of any material change and update the effective date above when we do.
